However, a large number of logos (the majority?) do not have the required content for copyright protection. Do the US Copyright Office’s decisions seem arbitrary? Perhaps. That was the argument implied by owners of the Geek Squad trademark when they applied for copyright registration of their logo. They said it was similar to the Hot Wheels mark in creativity. But Geek Squad was still denied a registration for copyright. Interestingly, the most recent version of the American Airlines logo was denied a copyright registration, but after lengthy litigation, it was finally awarded a registration. So, yes, whether a mark qualifies for copyright protection can be a judgment call, not always black and white (no pun intended). But what area of law is not full of judgment calls? That’s why judges are called judges, right?
